Military retirement? My dad retired from the military after 24 years, so of course he received retirement. He passed away a couple of years ago, does his retirement go to my step-mother or does it just stop completely? She's a wonderful woman, so I hope she still gets it. Anyone know?
Military Retirement? How long do you have to be married to someone in the military before you are able to receive a portion of their retirement even after divorce? Or is this even possible? My friends parents were married for 13 or 14 years before separating and her mother was a candidate for receiving a portion of his retirement funds until he dies.
Is the military retirement pay system being scrapped? I recently came across an article about the military changing the retired pay system. In essence they will put it more in line with the guard and reserves pay system. This means retired pay will begin anywhere from 57 to 62 years of age depending on how long you serve. I certainly hope this will not affect currently retired members because I depend on my retirement to live. How can they do something so disastrous to members of the military? I'm only 53 years old.
how are civil service and military retirement different? i know that military starts receiving retirement after their discharge. but i was told that civil service is just like regular retirement and had to wait till age 65.is this true? he was also mititary during some of his civil service,does this matter?

Military retirement and ss check same month as death? My ex mother in law is about to die. She gets a retirement check from the military and ss benefits. Her checks come in on the first of the month. If she dies after the first of the month, doesnt the family have to return those checks since she didnt live through the month. I have heard this and the family doesnt think this is correct. Years of Service for military retirement? I am trying to get information on guidelines or how years of service are computed for the sake of military retirement. My husbands DIEMS on his LES reads 880202 it shows Yrs Svc as 20, however, it was only recently he was allowed to choose a retirement plan (which is usually done at 15) He is currently Navy but prior to this served in Army and Reserves but with breaks in service. Are these dates what is used to calculate his eligibility for retirement? Or is there another system using the actual time he has served?
When do you begin receiving checks for military retirement? My initial understanding was that once you hit your 20 years of service, that you'd still have to wait until you're around 60 years old to get anything. What are some government careers that carry over time for retirement from military? What is the difference between total career points and retirement points in the military? I spent 3 years, 9 months and 10 days on active duty (was released 3 months early for graduate school) That gives me on my retirement printout 1371 retirement points. Then, I joined the guard and received another 164. Total retirement points 1535 for a total 5 "good" years. However, I also did some correspndence corses which I was told to turn in to the retirement person which shows up on my printout as "ACCP Misc Points" and is added to the "Total Career Points" column--NOT the "Total Points for Retirement Pay" column. Question--what is the difference between "career points" and "retirement points?" If career points are not calculted for retirement pay, what are they good for? To the one responder so far--I am sure you know what you are talking about--however, I have no idea what "non-retirement bond" means.

You get 50% of the pay you earned while you were still in the military. So if you join when your 18 years old you can retire when you are 38, plenty young to get another job. I don't care what a soldier or marine or whatever has done, nothing justifies taking half of their retirement pay! WE are the ones that fought the wars. WE are the ones that go to the field problems. WE are the ones that work endless hours. WE are the ones that have to put up with all the BS that comes with being in the military. WE are the ones that have to abide by not ONE, but TWO justice systems. WE are the ones getting put through all this, and no matter what happens between a husband and wife, I think someone's hard-earned retirement should have NOTHING to do with it!!!! When a civilian wife gets beat by her civilian husband or when a civilian wife leaves her civilian husband for his best friend, they're not entitled to half of their social security, so why should the military be any different? I'm active duty army, and so is my husband by the way. No matter what he did for us to get divorced, I would never touched the retirement he's bled for, and cried for, and lost friends for, and worked so hard for. Our marriage has nothing to do with the fine service he's done for his country. Same goes the other way, too. Andrea, as a soldier, I also suffer through being separated from my family and living on low income, and moving constantly. Difference is, when we're going through all this stuff, we're also trying to keep out butts alive, and we can't fly out to our mom's house or our sisters house to get some comfort. We can't lie in bed all day crying because it's so hard. We still have a job to do, and no matter how hard it is for us, how long we work for (i.e. my 16 hour days from 6pm to 10am in Iraq right now) for very little pay, we still go through all those same emotions, with one big difference, being that we are in a warzone. I don't doubt the mlitary wife role is hard, I'm just saying that it shouldn't be a reason to take the retirement WE worked so hard for. What if its the other way around? What if the soldier is the victim, i.e. the soldier deploys, the spouse cheats, the wife (who chose to never work a day in her life) is out and about getting drunk, leaves the kids at home alone overnight, kids play with matches, house burns down, soldier comes home to a burnt down house, kid injured from house fire because she was too busy getting laid somewhere, b***h spent all the money on her boyfriends and partying. He divorces her, she gets 30% of his retirement.....Is that fair??? Just FYI, I AM married to a military member as well. I am his support, even though I'm also here, I can't physically send him care packages, so I order them online for him. I email him every chance I get. I, too, have to go through my nights by myself, hoping he's ok. I, too, had to watch the kids by myself, when he had to go to the field. I take care of paying the bills, we split the house chores, and we both go to school, so yes, I know what it's like to be a military spouse as well, and it doesn't compare to the service members side of it. He outranks me so I have to follow him, same as a civilian wife following her military husband.
To clarify my last question...is military retirement pay immune from civil judgment? A sailor with only 6 weeks left before retiring from a 20 year tour of duty admitted in open court that he had "borrowed" $110,000.00 from his grandmother without her knowledge. Criminal charges were not pursued because grandma, despite his theft from her, loved her grandson and didn't want to hurt him. The Court then issued a civil judgment against him and he promised to start repaying her from his military retirement pay just as soon as he retired. He's never repaid a cent and the VA tells me his retirement pay is untouchable but cannot, or will not, tell me any law that makes it so. Thanks to all of you who answered my first question but none, really answered it....what LAW makes all of this so??
Can he stop his ex from getting his military retirement? When my husband divorced his ex-wife, she was awarded 27% of his military retirement. He said his lawyer at the time told him that he had to give it to her or she would get more than that. If they end up back in court over child support, etc...he is planning on trying to get it changed where she is not entitled to any of his retirement. Is there any way that he has a chance of being successful and keeping her from getting any? What are his options? Does he have any? He has worked way to hard at his military career and she is the one who cheated on him when they were married and wanted the divorce. Do you think he can get this changed? This has nothing to do with child support. This is separate. She was lazy and never helped him with the house or the kids and didn't have a job either. Then when he was away, she cheats, wants out and a friend of hers told her she could get part of his retirement in the divorce, so she tried...she was asking for 50% but ended up with %27.
military retirement pay and inflation? Every year congress approves pay raises for the military (usually around 3.5%) to stay in balance with inflation. Does retirement pay stay on par with this? For example, if i was to retire tomorrow after serving 20 years active duty and retire as an E-8, would my 50% retirement pay entitlement stay on par with the CURRENT year's base pay of an E-8 with 20 years in? Like when 2009 or 2010 rolled around, would i still be receiving 50% base pay for that current year's income of an E-8 with 20 years in? Or does it get stuck, and that 50% pay is based off the year you retired in and doesn't increase with inflation? you can receive COLA with retirement pay? that's something i didn't know
If I get chapterd from the military for not having a primary care plan, can I still get my retirement? I'm a single parent and have 2 children living with me who do not have a relationship with they're mother. I do not have anyone to list as a primary care plan in the event I deploy. My unit is considering chaptering me out because of this. My retirement package has already been approved and I am due to retire in 9 months. Can I still retire and collect my retirement pay as well as receive an honorable discharge?

There's the education center, you can use your spouses G.I. bill.......and what about all the benefits you got FOR FREE simply because you were married to him??? Does that not count for anything? Or what about when the civilian husband who always beats his wife all of a sudden leaves his wife who's in the mlitary to raise the kids by herself, and the civilian husband gets half of her retirement pay? can military retirement pensions be garnished? my husband is retired military and he and his ex-wife are in a child support/ex-spousal support court battle. we are wondering, if he loses, can she have his retired military benefits garnished every month to get her support? (the back support). also, if this can be done, does anyone know if she is entitled to a specific percentage? or can they garnish the total amount at 1 time? thanks!
Military Retirement Checks, do they really give it to............? Ok, I'm 18 and bout to go navy. I might wana retire. Ok you know how the human life span gets longer over time. well they say when I'm 62 my health will be at the age 25 so say you never die, will you still keep getting the check? this sounds crazy but hey back then space travel sounded crazy.
Military, Divorce and Retirement? I am a former military spouse. I married him 2 months before he went into service. We were married exactly 18 yrs 1 month and 1 day. The divorce was in January of 2003. I had no money to pay for a lawyer, he cheated on me with his former High School sweatheart and wanted to be rid of me so he could marry her. The lawyer he hired tried to talk fast thru the retirement portion , but I catch on quick and told him, I was entititled to 1/2 of my husbands pension. I did not sign anything until this was amended. Now the problem is. My Ex retired July 1st 2006, I knew it was coming so back in January I filed all the nessesary paperwork with DFAS. They denied me! Because the Divorce decree reads Quote" The respondent is entitled to half of the martial portion of the Petitioners pension." They say this is not good enough, it has to say a certain percentage like 50%. Apparently DFAS does not understand HALF! Sent ex a DFAS affidavit, that would clarify this for them. He refuses to sign! Help!
Military disability/Retirement pay and tax...? I was injured out of the state on active duty. I was found unfit for duty and placed on TDRL, now when i got my monthly check they did not take out state tax. Will I have to pay state tax on that money? (it was non combat related)
Let me Clarify Military Divorce and Retirement!? As to Christina's response, I am NOT a money hungry witch! Apparently you are not military and have no earthly clue what you are talking about! I have a job and always held a job during our marriage! Plus raising 2 children with NO BABYSITTERS! This is something that the Military does for former spouses. It is my entitlement under their rules and regulations! I am am damn sure not going to give it up! I would be stupid to! As to the second person who is military and knows some of what he is saying. My ex was in a total of 21 yrs and did not go up in rank, DFAS gave me a formula that figured out what my portion of entitlement should be 18 yrs -v- his 21 yrs with no upgrade in rank. It comes to 42%. This is in the affidavit sent to him, by myself, Dfas,and my lawyer.I am not asking for anything other than what I am entitled to under military laws and regulations. I would be an absolute fool not to. What? I am going to walk away from over $600 a month for the rest of my life? Would you?
Military Divorce and the REAL answer on retirement dispersment? I'm a Retired Military E-7 married to a civilian. I enlisted in 81, married in 94, separated in 99 and retired in 03. There are no children from this marriage. What exactly is her entitlement to my retirement? I've heard so many different responses it makes your head swim. I initially received BAH in 86 after the birth of my son from a previous relationship and my soon to be X is under the assumption I received the BAH due to our being married and is contesting I withheld her share during our separation. Can someone provide an answer or either a source I can get this info from. t/u
