Social Security benefits in Child Support?

I am divorced for five years now. My ex husband will retire this year, at 65. We have a 9 year old son, and I want to know if that social security amount will be considered "INCOME" for child support? I realize he is gettng a retirement from his school, but is social security in addition to that ? I live in NY

  2. Requirement benefits varies from state to state and are different and you would have to contact the Social Security Office there is New York regarding this question as I am from a different state and do not know of their requirements.
  3. i dont know why he would retire knowing he has a 9 yr old to support... odd, isnt it? i looked up your state and if is SSI, nope cant touch it, if its SSD you can (comes out of the check). but i dont know if its still considered income or not. i also dont know if he's required to carry medical insurance on the child or not and what sort of pensions he may have... and what your state will allow as income. you best bet is to call social security yourself, talk with a supervisor. SS workers dont always know the proper facts, so make sure you speak with a supervisor. also call your caseworker and ask about what is allowed to be considered income, his retirement funds, investments, etc. if he owes arrears: 1) call your caseworker and ask: --request an enforcement hearing. --where you apply for interest on the arrears? --was the case submitted for tax refund intercept? --was the arrears reported to the credit reporting agencies yet? --ask why they have not taken his drivers license away yet? --ask why they have not put leins on his bank accounts yet? --ask why there has not been a warrant issued yet?
