How does alimony work if I retire from my career?
I owe 40K/yr, but how does that work if I retire. Do I see owe my ex-wife the remaining money? If that is the case, I will be left with A HELLUVA LOT LESS than half of my assets. - If you are over a certain age, 62, and you and your former spouse were married more than ten years, I think the former spouse is entitled to part of the retirement. This is to protect the former spouse from becoming destitute. If your marriage lasted over ten years, she is still entitled to some of the assets. Don't stiff her out of spite.
- talk to a lawyer in your state. he will give a free consultation.
- You can apply to the court for a reduction in payments if you retire or lose a job. However, if you already are past due and owe her the money, then you pay it all. Brighten up, if you have less than half your assets, then she will also have less than she planned on. If you had remained married, she would have been entitled to half in most states. Its your social security she is entitled to if you were married to her for more than 10 years, not your retirement income. There are a few more requirements that she meet in order to collect on that. See a lawyer for your state, before taking anyones advice online.
