- Thats true, if he remarries he can't draw off yours.
- yep, if he is not remarried and he was married to you for I think it is 12 years, call SS they will be glad to tell you.
- How divorce affects your future retirement benefits If you are divorced after at least 10 years of marriage, you can collect retirement benefits on your former spouse's Social Security record if you are at least age 62 and if your former spouse is entitled to or receiving benefits. If you remarry, you generally cannot collect benefits on your former spouse's record unless your later marriage ends (whether by death, divorce, or annulment). This last one, of course, applies only if you were to die. How remarriage affects survivors benefits In general, you cannot receive survivors benefits if you remarry before the age of 60 unless the latter marriage ends, whether by death, divorce, or annulment. If you remarry after age 60 (50 if disabled), you can still collect benefits on your former spouse’s record. When you reach age 62 or older, you may get retirement benefit on the record of your new spouse if they are higher. Your remarriage would have no effect on the benefits being paid to your children.
- I think you should ask someone at the social security office www.socialsecurity.gov I don't think he could have though. Usually only children can. Spouses generally can only if they are still married.
- That is true. When a couple gets married and then divorced and the one gets remarried the person does not get the others social security. I am remarried and am not entititled to my ex's s.s. My ex was remarried and he died and his wife is also not entitled to his s.s. because they would have to be married for 10 years for his wife to get his s.s. They were only married for six months when my ex died. I am very glad that she can't get it.
- He cannot draw off your social security. That is your financial support which your gave to yourself through your life of employment. It is your personal account, nothing to do with him. Don't worry about it! He's got his own coming, if not already. Why is he trying to get yours?!
