- By giving a father's the right to ILR within the UK simply because they have a child in the UK by a British citizen, would be the road to disaster for many. How would you know that the man who got you pregnant was not after ILR rather than you? then once he had it would or could run off and leave you with a baby. This would certainly make the birth rate in the UK rise, and would open the flood gates even more than they are now. Have you not considered sponsoring him for a visa yourself? Can he get a work visa?
- I don't know any law that would bring him here through your kid. But if he doesn't have an illegal or deportation history for UK, then there are always other ways, such as visitor visa, student visa, HSMP if he is qualified, or if he is very lucky a work visa. What is your status? If you had a lawful residency, he could easily get dependent visa through you, otherwise, maybe he can get a visitor visa from one of your friends who is citizen and can sponsor him. But then he wouldn't be able to stay here more than 6 months, or to extend his visa at all. I think the best way is student visa. It's easy and has a high chance but he has to go to a class for 15 hours per week. Then after he could get a work permit visa if he has finished a degree here, and with 5 years work visa, he could get permanent residency. Good luck
- The UK immigration laws/rules should outline the procedures required, so, follow them.
- Why not go and live in his country?
- If you think that kids need their dad so much and that family is important for you then you should consider sponsoring him to the UK or living in his country. The Republic of Ireland used to have a law where if a child was born in Ireland and not only was the child Irish but the parents got residency. They found out the hard way that immigrants would come over, use it for easy access to the EU and then leave or stay for the benefits. As a result they abolished this in 2004. But your father of your kids is welcome to come to the UK if he can prove that he can support himself with resorting to benefits and can be a productive member of society. See link for more details.
