How much of a military retirement check can an Ex spouse be awarded in a divorce?
A frind of mine has to appear in court. His Ex. is seeking an increase in support . She is asking for all of his Military Retirement. Is this possible

- My dad was USMC and I can tell you this: my mom filed for divorce and went after his retirement also - she had to fill out a ton of forms and show proof of being married a minimum of 20 yrs or more before they would even consider it. And in the end no she was denied his retirement, but they did tell her that after my dad passed away that she could file for it then.
- Depending on the longevity of the marriage, I have heard as much as 50%. It's a shame. If she wanted a military retirement, she should have done 20 years.
