How much of his Retirement from calpers can I get from our divorce? And where do I start the process?

I was a stay at home mom for 20 years married with 3 kids for 13, he walked out when the kids and i were on vacation to be with his boss. i took care of his demented grams and retarded uncle for 5 years. He has physical custody pending a phych eval for me questioning my parenting judgements. I am unemployed with no family in the US, he was a correctional officer for 13 years, and has full retirement after an injury. He has a new place, furniture and a new mustang convertable. He made no provisions for us for 3 months after returning, and I am not a Gold Digger. I was a wife and a good mother, He just decided he wanted to be free to fish in the ocean of women who catered to his ego. His boss is a divorce with 4 kids, and is independent. But she fired him so he wont show income aside from the retirement, and Im sure will rehire him after the divorce. I gave 20 years to this man, half my life. I think I deserve half of what was OUR retirement. Right?

  2. Your not being specific enough. Age? Kids? How long you were married. If you think your getting some type of alimony type settlement, good luck with that. In today's day and age it just isn't common unless the husband is rich.
  3. "Shadow" is right....what are the factors that would warrant getting any of his retirement money? Also, I agree, alimony is not the "norm" anymore, especially if you have been working.....
  4. Hire a divorce lawyer. The split between you and your spouse depends on several things. The final decision by the judge will depend on your financial situation, child custody, etc. Target to get 50% of his Calpers retirement money.

According to CA divorce law, you get one half of his CalPers retirement benefits. You are only able to obtain your share of the fund when You retire at 55+. During that time, your share remains in suspension. You cannot add to it or collect it before your retirement date. For further detailed information and options, contact the CA Personal Retirement System website and speak to a representative. Also, make certain that your lawyer has the CalPers included in the divorce settlement. Plus, it is NOT part of any alimony or child support payments.
